We have experience representing clients who seek to be appointed as guardians on behalf of disabled persons, from preparing the petition, determining whether guardianship of the person, guardian of the property or seeking guardianship in both capacities is appropriate, to obtaining the necessary medical professional certificates. We also represent clients in contested guardianship proceedings. Once appointed as guardian of the property, we advise clients of their fiduciary duties and their annual reporting responsibilities. In addition, we represent clients seeking to terminate or resign from their capacity as guardian of the person and/or property.
For minors, guardianship may be needed by a third party for purposes of making educational or health-related decisions. Guardianship is a less obtrusive process than seeking custody of a minor and is often viewed as an alternative means to be appointed by a court in order to make specific decisions on behalf of a minor child’s person and/or property.
