David Hisle is a Maryland and District of Columbia litigation attorney with Lewicky, O’Connor, Hunt & Meiser, LLC, in Fulton, Maryland. Business and Commercial Litigation

Here are a few examples of David Hisle representing business owners involved in contract disputes, LLC/member disputes, corporate shareholder disputes, fiduciary-duty claims, business owner disputes, vendor/customer disputes, and/or enforcement of settlement agreements:

Breach of Contract – Government Contract:  David’s client was a subcontractor performing large-scale construction work in a federal office building. The primary contractor refused to comply with the terms of the parties’ contract and various requirements under federal law.  Through negotiation, David assisted his client in resolving this matter through a settlement.

Breach of Contract – Business Partnership Dispute:  David’s client was a partner in a successful business. The partners found themselves in a complex buyout dispute.  Following the initiation of lawsuits by both partners, David assisted his client in resolving this matter through a settlement.

Breach of Contract and Commercial Lease Dispute:  David’s clients were business partners engaged in a profitable retail business. The clients found themselves in a contractual dispute with the remaining business partners and with the commercial landlord.  David assisted his clients in resolving these disputes through a successful settlement.

Employment Litigation

Here are a few examples of David Hisle representing employers and individual employees in employment disputes, which can include employment agreements, severance agreements, wrongful termination claims, EEOC discrimination claims, retaliation claims, wage disputes, non-compete claims, and/or FMLA disputes:

Wrongful Termination and EEOC Claim:  David’s client was a federal contractor. The client alleged that she had been a victim of discrimination and was wrongfully terminated.  Following negotiations, David assisted his client in resolving these disputes through a successful settlement.

Breach of Contract: Non-Competition Dispute:  David’s client was a company engaged in computer software and cybersecurity.  One of his client’s employees left the company and began working for a competitor in breach of his employment contract. Following the initiation of a lawsuit and subsequent negotiations, this dispute was resolved through a successful settlement.

FMLA Dispute:  David’s client was an employee who needed leave due to an illness. The client’s employer failed to comply with FMLA requirements and threatened to discharge the client.  Following negotiation, David assisted his client in resolving this dispute through a successful settlement.

Family Law

Here are a few examples of David Hisle representing clients involved in family law disputes, which can include matters of divorce, child custody, child support, protective orders, or modifications of custody orders:

Custody Dispute:  David’s client was the parent of three minor children. The other parent initiated litigation through custody complaints, custody and access modification requests, and protective orders, in an attempt to obtain primary physical and sole legal custody of the client’s three minor children, and limit the client’s access to the children. David represented the client in the resulting custody and support hearings.

Child Support:  David’s client was a parent who was not receiving the appropriate amount of child support under Maryland law. The other parent failed to accurately report income, and there had been past miscalculation of support obligations by the State’s child support bureau.  Through litigation and the pursuit of an audit with the child support enforcement bureau, David assisted the client in obtaining appropriate monetary support.

Divorce and alimony:  David’s client was a parent navigating a challenging divorce. The client had limited income but maintained significant responsibilities and expenses for the care of the parties’ minor children.  David represented the client in the resulting court hearings that adjudicated custody of the minor children, alimony, and a marital award.

Protective Orders:  David’s client had been involved in a difficult and dangerous relationship.  Police had been called on several occasions. David represented the client in court proceedings seeking a protective order.

Real Estate Litigation

Here are a few examples of David Hisle representing clients involved in property disputes, such as disputes over title, boundary line disputes, easement disputes, landlord-tenant disputes, lease disputes, and/or peace orders:

Boundary dispute:  David’s clients were in a contentious and costly boundary dispute with their neighbors. The dispute involved the destruction of the clients’ property and a contested survey.  David assisted the clients in obtaining a successful settlement.

Landlord-Tenant Dispute:  David’s client was the owner of real property and a landlord.  The prior owner/landlord entered a “lease to purchase” agreement with a tenant. Upon the client’s purchase of the property from the previous landlord, the tenant refused to pay rent, claiming that the property should not have been sold to the new owner.  David represented the new owner in a multi-day jury trial and subsequent appeal.

Peace Orders:  David’s client was involved in an escalating dispute with a neighbor. The client’s neighbor engaged in a series of destructive, harassing, and threatening actions and behaviors.  David represented the client in seeking a peace order.

Criminal Defense

Here are a few examples of David Hisle representing criminal defendants in matters such as DUI / DWI, traffic citations, assault, battery, theft, and other types of felony, misdemeanor, or juvenile cases:

DUI:  David’s client was arrested for driving under the influence (DUI). David assisted the client in obtaining the ignition interlock device, completing the appropriate classes, and guiding the client through the challenges posed by the MVA and the court system, including plea negotiations.

Assault and Battery:  David’s client was charged with assault and battery stemming from an incident outside of a bar. Through negotiations with the prosecution, Davide obtained a resolution acceptable to the client and the State.

Theft:  David’s client was charged with theft from a retail business. Through negotiations with the prosecution, Davide obtained a resolution acceptable to the client and the State.

Juvenile:  David’s client retained our firm after the client had already been adjudicated delinquent.  David represented the client at the disposition and post-disposition hearings.
